Adoption and Surrogacy

Employees are no longer required to have completed 26 weeks’ service before qualifying for Adoption Leave. The rate of Adoption Pay is now payable at 90% of the employee’s normal weekly earnings for the first 6 weeks of leave, bringing it into line with SMP. New regulations entitle couples who are adopting a child from outside the UK the right to Shared Parental Leave and Pay.

Single and joint adopters are now entitled to take time off work to attend adoption appointments, subject to limitations.

Employees fostering a child under the ‘Fostering for Adoption’ Scheme are now entitled to Adoption Leave.

Employees who have a child through a surrogacy arrangement are now entitled to take adoption leave and pay, paternity leave and pay and shared parental leave and pay, subject to eligibility criteria.
